1. Service Description

HealthSync AI (the "Service") is a wellness health tracking application that combines wearable device data, manual health entries, medical records, and artificial intelligence to provide personalized health insights. The Service includes glucose tracking, AI-powered wellness nudges, care circle collaboration, and lab result management.

2. Not a Medical Device

You should always consult a qualified healthcare professional before making any medical decisions. Do not disregard professional medical advice or delay seeking treatment because of information provided by HealthSync AI.

3. Advisory Language

All AI-generated content within HealthSync AI uses advisory language. This includes but is not limited to:

• Daily health summaries and trend analysis
• Wellness nudges and reminders
• Glucose pattern insights
• Activity and sleep recommendations
• Alert de-escalation guidance

These outputs are generated by artificial intelligence based on your data patterns and are suggestions only, not medical advice or prescriptions. The accuracy and applicability of AI-generated content may vary.

4. User Responsibilities

By using HealthSync AI, you agree to the following responsibilities:

• Accurate Data Entry: You are responsible for entering accurate health information. Inaccurate data may lead to inaccurate insights.
• No Sole Reliance: You agree not to rely solely on HealthSync AI for medical decisions. The app is a supplementary tool, not a replacement for professional healthcare.
• Emergency Situations: In a medical emergency, contact your local emergency services immediately. Do not rely on HealthSync AI for emergency medical guidance.
• Account Security: You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
• Lawful Use: You agree to use the Service only for lawful purposes and in accordance with these Terms.

5. Account Terms

• You must be at least 13 years of age to create an account.
• Each person may maintain only one account.
• You must provide accurate and complete registration information.
• You are responsible for keeping your account information up to date.
• You may not share your account credentials with any other person.
• You must notify us immediately of any unauthorized access to your account.

6. Subscription Terms

HealthSync AI offers the following subscription tiers:

• Billing: Paid subscriptions are billed monthly through the App Store or Google Play.
• Cancel Anytime: You may cancel your subscription at any time. Your access to premium features will continue until the end of your current billing period.
• Refunds: If you cancel within the current billing month, you are eligible for a refund of that month's subscription fee. Refund requests should be submitted to legal@healthsyncai.ca.
• Price Changes: We will provide at least 30 days notice before any price increases. Continued use after the effective date constitutes acceptance.

7. Intellectual Property

All content, design, graphics, user interface, code, and proprietary features of HealthSync AI are owned by HealthSync AI and are protected by Canadian and international copyright, trademark, and intellectual property laws.

You retain ownership of all health data and personal information you enter into the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing and improving the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• HealthSync AI is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We are not liable for any health decisions made based on data, insights, or suggestions provided by the app.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability to you for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated insights.

9. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Provide false or misleading account information
• Use the Service for any illegal or unauthorized purpose
• Attempt to interfere with the Service's infrastructure or security
• Share or distribute your account access with unauthorized parties

Upon termination, your right to use the Service will cease immediately. You may request export of your data prior to account deletion. We will retain your data for 30 days following termination to allow for data export requests, after which all data will be permanently deleted.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Hamilton, Ontario, Canada.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
